Legal expertise

Our lawyers advise and represent our clients in Ticino and throughout Switzerland before all cantonal and federal administrative and judicial authorities as well as in arbitration proceedings.

  • We assist and represent our clients – be they private individuals, companies or public institutions – in all kinds of civil and commercial disputes, as well as in administrative and criminal matters before all municipal, cantonal and federal judicial and administrative authorities.

We structure our litigation team according to the needs of our clients, combining trial strategy expertise with professional experience in judicial authorities and specific legal knowledge. We strive to resolve disputes in a timely and cost-effective manner.

Our lawyers' proactive approach and sensitivity in safeguarding our clients' interests are factors that enable us, where appropriate, to reach an agreement between the parties during or before litigation proceedings.

  • Through multidisciplinary and tailored advice, our lawyers support individuals and companies in all matters relating to their life and business, providing the skills, creativity and focus needed to develop and strengthen their personal and business relationships.

We assist our clients in drafting contracts and in negotiating with counterparts, making sure that our clients' relationships build upon a solid contractual framework. Whether it is agency, service, distribution, commercial agency or sale and purchase agreement, our dynamic, multilingual team possess – thanks to the experience gained in leading Swiss law firms – a comprehensive know-how and a genuine interest in the subject matter, which enables us to find legally sound and balanced solutions.

Our lawyers, who practice in the most diverse areas of civil law, also advise and represent clients in the field of the law of persons, with a particular focus on the protection of the legal personality and media law.

  • Our lawyers have a strong affinity for real estate and construction law, in which they are also active as lecturers at universities of applied sciences and for leading companies at cantonal and national level.

Our aim is always to provide a comprehensive and qualified service, which also includes tenancy and usufructuary lease law, real estate property law (e.g. servitudes and neighbours disputes) and, in general, ownership law and brokerage (including co-ownership and condominium ownership, with a special focus on real estate brokerage).

We advise private individuals as well as companies and public institutions in the field of contract law and in the resolution of disputes in the area of construction and contract for work and services law: from procedures for the establishment of statutory mortgage rights to the regulation of real estate projects and their promotion for the benefit of project owners, construction companies, architecture and civil engineering firms.

We also carefully guide our clients through proceedings under public law for the grant of a construction permit and when an objection is raised against a construction project application, and represent them before all municipal, cantonal and federal authorities at all levels of jurisdiction.

  • Whether it is the implementation of a case of inheritance, the administration of an inheritance estate or the examination of the rights of an heir in the context of a case of inheritance, we offer our clients careful and precise advice. In doing so, we always proceed with the necessary humanity: this is essential in such a context, in which legal knowledge must be combined with sensitivity and acumen. Indeed, in the context of a case of inheritance personal relationships are shaped, and the present and future family balance is at stake.

Private individuals and entrepreneurs are the backbone of our economy and require dedicated, tailor-made services. Through our lawyers – who can rely on a worldwide network and their own long-standing experience in Switzerland and abroad – we are able to provide comprehensive advice to even the most demanding and diverse clientele. The spectrum ranges from family and private businesses to professionals working for large corporations, from family offices to executors of wills and financial institutions.

  • Whether advising entrepreneurs, representing managers or representing the interests of employees, clients will always find a reliable partner in our lawyers’ team to avoid or resolve any kind of dispute in their company or workplace.

We provide our domestic and foreign clients with comprehensive advice on the structuring of their professional relationships, the establishment of solid contractual and regulatory frameworks, as well as on termination of the employment relationship, non-competition clauses and other employment disputes.

  • Our specialists’ analytical skills and knowledge of the economic environment enable us to act swiftly and with shrewdness, guiding our clients through the hidden dangers of financial difficulties and personal liability.

In particular, we represent private individuals and companies in the recovery of debts and the safeguard of assets in the event of debt enforcement and attachment proceedings initiated by third parties or in difficult bankruptcy proceedings.

  • Public law governs the relationship between citizens and the state and between public institutions. Our clientele – consisting sometimes of citizens, sometimes of public agencies themselves – can count on our support in all areas of public law, from spatial planning and land use to public procurement and expropriation law, from road traffic law to foreign nationals law.

When it comes to government action, a good knowledge of the political processes is essential: our institutional activity at municipal, cantonal and federal level enables us to act efficiently and effectively to assess opportunities and risks, and to identify the best solutions for our clients’ needs.

  • Criminal proceedings are often complex and exhausting. Our team stands by our clients to ensure that their rights are safeguarded before the cantonal and federal criminal authorities. We help persons suffering harm protect their interests, defend individuals and companies involved as accused persons in criminal proceedings, and assist our clients in filing criminal complaints and reports of criminal offences as well as reacting to seizures, forfeitures and the initiation of proceedings for recovering damages.

Our lawyers participate with the same commitment in the on-call service for appointment in mandatory criminal defence cases, which is jointly organised by the Ticino Bar Association, the Public Prosecutor’s Office of the Canton of Ticino and the Office of the Attorney General of Switzerland.

  • Thanks to the experience we have gained at some of the most renowned law firms specialised in arbitration in Switzerland and internationally, as well as to a solid academic training in this field, we advise and represent our clients in national and international arbitration proceedings based on the most common rules of arbitration as well as in ad hoc proceedings.

  • Our clients can count on the experience of some of our professionals in the field of data protection and technology law (both in the form of assistance in drafting contracts as well as in risk assessment matters), sectors where the legal framework is constantly evolving.

Clients who give free rein to their creativity and need to protect their intellectual works can rely on our team. Through careful analysis we will be able to conceive and implement a protection strategy tailored to their specific needs.

  • Whether an idea is still in its nascent stage or is already an existing entrepreneurial reality, our lawyers are the ideal sparring partner to promote and carefully assist a business project – from its creation to the management of daily challenges, from the manufacture and distribution of products to the provision of services and the protection of technologies.

We rely on a versatile and multilingual team that have gained experience in some of the most prestigious law firms in Switzerland, following first hand important transactions and regulations of relationships with business partners. We are able to meet the needs of any company, regardless of its size.

Our professionals have also distinguished themselves in advising cultural organisations, non-profit associations and prominent national and international events.

  • We assist our clients in the field of tort law, in particular in the determination of damages (for pecuniary losses) and satisfaction (for moral damages) suffered. We also represent our clients in the context of the liability of public institutions and officials.

Some of our experts are active in the field of insurance and medical law and offer their expert advice with the aim of tackling even the most sensitive issues with the necessary calmness.

Notarial services

Thanks to the synergies with our local notary partners, in particular with notary Giovanni Merlini, we are also able to offer our clients support and assistance in all areas of notarial law.

  • In the real estate sector, the law prescribes the form of the public deed for a wide range of legal transactions, from land sale and purchase agreements to the establishment or modification of condominium ownership, from the restructuring of parcels of land to the issuance of mortgage certificates and establishment of servitudes.

Together with our local notary partners, we advise and assist you in all phases of these transactions, pursuing a clear objective: providing you with proactive and dynamic support that is not limited to the formal aspects of notarial work, but promotes the convergence of the interests of the involved parties and the avoidance of post-contractual conflicts.

  • A case of inheritance is a delicate moment for any person or family: there is a danger of breaking a certain status quo and putting assets at risk. In order to avert such dangers, the law offers the testator a variety of options, which can be exploited in particular by drafting a will or a contract of inheritance.

The conception and implementation of effective inheritance planning is a demanding task – both in human and technical terms. Supported by our local notary partners, we guide and assist you in this process in order to find, together with you, the solution that best suits your wishes. In an initial exploratory meeting, your expectations are determined. These will then be translated into a notarial deed and subsequently refined until the achieved result meets your requirements.

  • The Swiss legislator dictates the form of the public deed for a vast number of corporate transactions. The spectrum ranges from company formations (in particular of Companies Limited by Shares and Limited Liability Companies) to corporate restructurings (in the form of mergers, demergers, transformations or transfers of assets and liabilities) and includes all transactions for which an amendment to the articles of incorporation is required – in particular an increase of share capital, a change in the company's object and registered office as well as any structural adjustment. The form of the public deed is in principle also required for the establishment of foundations.

We combine legal and notarial expertise in the field of corporate transactions with a strong sense of financial and management dynamics. We can provide comprehensive support to individuals wishing to embark on a new entrepreneurial undertaking or to companies wishing to adapt or consolidate their business. Likewise, in collaboration with our local notary partners, we assist clients who want to set up a foundation or apply for its tax exemption.

  • Appropriate planning of the marital property regime makes it possible to prevent future conflicts and, especially in the presence of considerable assets and increased international mobility, to develop solutions that are tailored to the needs of the spouses. The options provided for by the law are not limited to the introduction of the extraordinary marital property regimes of separation of property or community of property, but also extend to specific modifications to the provisions on the ordinary marital property regime of participation in acquired property.

The advance care directive and the patient decreed are two instruments that, although not yet very common, play a fundamental role in personal care planning and self-determination. They make it possible to arrange in advance the management of one's own affairs and the care of one's own person at an extremely delicate moment of the existence, namely in case of loss of the capacity of judgment.

Together with our local notary partners, we are at your disposal to develop tailor-made solutions in all personal and family matters. The starting point is an analysis of your individual needs – the aim is to help you take advantage of the opportunities provided for by the Swiss legal system, with competence and empathy.

  • Thanks to the cooperation with our local notary partners, we are able to assist our clients with any other notarial matter, such as authentication of signatures, of deeds, findings of fact and inventories of assets.

Notarial deeds intended for foreign countries usually require a certification of origin, which is provided for by affixing an apostille or by legalisation by the competent diplomatic mission. In this case, too, we can assist our clients and take care of all the necessary formalities for them.
